Terms and Conditions

Overview

Edufication is a web service, online store and learning platform owned and operated by South-Eastern Finland University of Applied Sciences Ltd (in Finnish Kaakkois-Suomen Ammattikorkeakoulu Oy Business ID: 2472908-2). Edufication web service and online store aims to increase the competence of customers by means of high-quality courses and other educational products. The products of Edufication are sold by South-Eastern Finland University of Applied Sciences unless otherwise stated for a specific product.

Thereinafter

  • in Edufication online store, the party selling the products is referred to as “Seller” and the party purchasing the products as “Customer”;
  • educational products and courses are referred to as the “product(s)”; and
  • the purchase of products by Customer is referred to as the “purchase” or “order”, regardless of the legal nature of the transaction.  

Terms and their application

These terms apply to the business relationship between Seller and Customer. The terms and conditions have been prepared by South-Eastern Finland University of Applied Sciences, which has the right to update these terms and conditions without notice. Orders placed by Customer are subject to the terms and conditions in force at the time of order placement.

Customer declares that it does not use any services or products in the United States, Canada or Russia.

Ordering products

Products are ordered from pulse.xamk.fi via the shopping cart. The completed order will be confirmed by e-mail sent to Customer, in which products ordered, the price of each product and the delivery costs are specified.

Upon order placement, Customer agrees to adhere to the valid terms of service.

The expiration date, until which the product is accessible to Customer, is specified in the product descriptions.

Order acknowledgment and payment confirmation

Customer will receive an e-mail order acknowledgment, which specifies the products ordered, the price of each product, delivery costs, tax breakdown, and the total amount of the invoice.

A prerequisite for receiving an order acknowledgment is that Customer has informed Seller about a valid email address upon order placement.

Prices and VAT

The price valid for orders placed with Edufication Online Store is displayed in the price list of the online store at the time of order placement. All prices are subject to change. All prices are quoted in euro (EUR).  The product prices shown in the online store are inclusive of the current VAT.

Registration

By registering for the Edufication, Customer agrees to the processing of their personal data in accordance with the data protection statement. When purchasing products from Edufication, Customer accepts the terms and undertakes to comply with these terms. The personal information provided by Customer is collected and stored in the customer register of Edufication. South-Eastern Finland University of Applied Sciences Oy does not disclose this information to third parties.

Customer confirms that the personal data provided upon registration is Customer’s own data and that s/he completes the purchased training independently. Completing an online course of another person is prohibited and a violation of these terms and conditions.

Disposition

The username is personal to Customer. Customer undertakes to store and use their usernames and passwords in such a way that they cannot be taken over by third parties. If Customer forgets the password, they can request a new password in the online store. Customer can change the e-mail address that serves as a username after logging in on My Information page in the Edufication. Customer is responsible for all use and subscriptions with the username and password, and for ensuring that use complies with the terms of this agreement.

Transferring the username to a third party is prohibited. Login to the website with another user’s ID is prohibited.

Customer undertakes to use the products in accordance with the law, good practice, and the terms of this agreement. Customer is personally responsible for using the product in accordance with the terms of the contract.

Delivery

Customer receives an email invitation to log in the Claned learning platform. Courses are implemented in the Claned platform unless otherwise stated.

The right to use the product begins when Customer has purchased the course and the course has been activated, or when Seller has provided the user with a user ID.

Copyright

Seller owns the copyrights for the products. Use, copying, printing, screenshooting, saving, modifying of the course content, delivering it to third parties, or translating it into other languages without a written permission of Seller is prohibited. Support material of a course can be printed for personal use.

Customer material

Customer is responsible for the material they send and the content they produce.

By sending material and producing content to the servers of South-Eastern Finland University of Applied Sciences, for example by e-mail or via the website, Customer accepts and confirms that:

  • Customer has taken reasonable steps before sending the material to detect and destroy any viruses or other harmful properties contained in the material;
  • the material submitted by Customer is not illegal, politically, religiously or otherwise offensive, threatening, obscene, derogatory or otherwise unfit for publication;
  • the material is Customer’s own material or Customer has an unrestricted right to provide the material to South-Eastern Finland University of Applied Sciences, and that South-Eastern Finland University of Applied Sciences or Seller may publish the material free of charge and / or include the material or part thereof in their own products without obligation for financial compensation or other liability; and
  • Customer does not make any claims against South-Eastern Finland University of Applied Sciences Oy or Seller based on the material sent by Customer. Customer undertakes to bear any costs incurred by Seller arising from measures taken by a third party to South-Eastern Finland University of Applied Sciences or its representatives on the basis of such material. If Customer publishes the material they produce in public or restricted areas of the website, Customer also allows other users to access such content and gives permission to view, store, and reproduce the material for the personal use of other users.

Purchase of certificates

When purchasing certificates from Edufication, Customer must provide the same e-mail address as they have used when logging in Claned so that their course completion can be verified. The certificate will be sent to the e-mail address provided by Customer.

Payment options

Products are paid upon order. There are two payment gateways used in Edufication online store: Stripe and Paytrail.

OP Lasku

Online payment method for customers of all Finnish banks
OP Lasku is an online payment method for special purchases in your everyday life. Customers of all Finnish banks can use OP Lasku.

  • 45-day interest-free payment period for your purchases
    This allows you to decide before paying whether you want to keep the product you ordered.
  • You can pay in instalments if you wish
    You can easily set monthly instalment payments if you wish. This way, you can pay off the invoice at your own pace.
  • Easily keep track of your situation
    You will receive your invoices in your email and reminders as text messages. You can also view your invoices in the OP Lasku online service.

A flexible way to pay for your online purchases
With OP Lasku, you can pay for purchases of up to 5,000 euros and pay them off interest-free within 45 days. You can also split the invoice into several instalments if you wish. You can view your purchases in a single place, which helps you keep track of your spending. You can keep your spending under a specific limit with the help of a credit limit.

You can receive your invoices by email. You can view information about your OP Lasku usage and the total amount of your purchases in the online service.
You can use OP Lasku if you are solvent, over 20 years of age, and have online bank identifiers to a Finnish bank.

Credit decisions are based on an overall assessment of solvency. For this assessment, you are requested to report your income and debt servicing expenses when you start using OP Lasku.

Your credit information will also be checked from the credit information registry. This will help you keep your everyday finances in control and balance.

What will it cost?
An account maintenance fee of 2.95 euros will be added to the invoice. If you receive several invoices in the same month, you will only be charged one account maintenance fee. The maintenance fee will not be charged if you do not receive an invoice. Thus, you pay for OP Lasku only when you use it.

You can only pay the minimum instalment from your invoice if you wish, in which case the remaining amount will automatically be set to be paid in instalments. If you pay in instalments, the yearly interest rate is 19.95%*.
*OP Lasku is a revolving credit where the actual annual interest rate for a credit of 1,000 euros is 26.84% when the interest rate of the credit is fixed at 19.95%, and the account management fee is 2.95 euros per month. The estimated total cost of the credit is 1,396.91 euros. This calculation is made with the assumption that the credit has been fully used, the interest rate, as well as the costs and fees, remain the same for the entire credit period, and that the credit is repaid in minimum instalments of 27.78 euros per month, with the credit period being 36 months. The credit is granted by OP Corporate Bank plc, Gebhardinaukio 1, 00510 Helsinki.

Cancellation

Products (online course, other digital content) are not subject to right of withdrawal of an order in accordance with the Consumer Protection Act (in Finnish, Kuluttajansuojalaki 38/1978) if the service has been completed or the online delivery of the digital content has begun with Customer’s consent and Customer has been notified in advance of the absence of the right of withdrawal.

Liability for damages

The product is offered as is, and no guarantee is given for its functionality on Customer’s device. Seller reserves the right to change the product, its availability, and hardware requirements.

Seller shall not be liable to Customer or any third party for any errors or omissions contained in the product or for any direct or indirect damages resulting from the use or interpretation of the information contained in the product.

Seller shall not be liable for any damages that may result from the operation of the product or the failure of the service. Seller is not liable for any direct or indirect damage caused by technical defects, malfunctions or interruptions in the product or the like. Any faults in the product will be rectified as soon as possible.

Force majeure

Seller shall not be liable for any non-delivery, difficulty in delivery, or delay in the delivery of the order or for any obstruction of the use of the product insofar as it is due to a circumstance beyond Seller’s control, such as an epidemic, storm, flood, catastrophe, war, or natural disaster.

Privacy Policy

South-Eastern Finland University of Applied Sciences processes Customer’s personal data in accordance with the register description, data protection clause of South-Eastern Finland University of Applied Sciences, and privacy protection legislation. The service uses cookies and other similar technology. More information on cookies and other data protection issues can be requested from the Data Protection Coordinator of South-Eastern Finland University of Applied Sciences, tietosuojavastaava@xamk.fi.

Applicable law

This agreement shall be governed by the laws of Finland, excluding its conflict of law provisions.

Dispute resolution

Disputes concerning this agreement will be resolved in the first instance in the Kymenlaakso District Court.

The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
